1. Who we are
Del Mar Races (“we,” “us,” the “Service”) operates the website at delmarhorseraces.com, published by the operator of this site. By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.
2. Not affiliated with the racetrack
We are an independent companion service. We are not affiliated with, endorsed by, or sponsored by the Del Mar Thoroughbred Club, the Del Mar Fairgrounds, the 22nd District Agricultural Association, or any racetrack, wagering operator, or racing authority. “Del Mar” and other race, track, and product names are used descriptively to identify the races we cover and the sources we reference; all trademarks belong to their respective owners.
3. Information and entertainment only — not betting advice
The Service provides informational and entertainment content about Thoroughbred racing: our own transparent speed figure, aggregated public-handicapper selections, and an open scoreboard that grades every source (including our own) over time. Nothing on the Service is betting advice, a recommendation to wager, or a promise of any outcome. We do not claim an edge over the betting market; our stated expectation is that no publicly available system reliably beats the takeout. Any figure, estimate, or “pick” is one input among many and may be wrong. You are solely responsible for any decision you make.
4. No wagering on this site
The Service does not accept, place, process, or facilitate wagers and does not handle any bets or money. Any wagering you choose to do happens through separate, independently operated and licensed platforms subject to their own terms and to the laws of your jurisdiction. We are not responsible for those platforms or for your activity on them.
5. Eligibility
The Service provides general information and entertainment about racing. It accepts no wagers and handles no money. Any wagering you choose to do happens through separate, licensed platforms that set and verify their own eligibility requirements — including any minimum age — under the laws of your jurisdiction. Those requirements are between you and that platform.
6. Third-party content and attribution
The Service references and links to third-party handicappers, publications, and data sources. We attribute each source and link out to it; we do not republish third-party article text, and we display only what our agreements and applicable law permit. Some inputs are used under license (for example, a licensed speed-figure product); branded figures are not redistributed. Only sources cleared under their terms of service are shown, and we add others as each is cleared. Third-party content belongs to its owners and is provided for reference only.
7. Our content
Our original content — our speed figure, write-ups, scoreboard, and design — is owned by us or our licensors. You may view and share links to it for personal, non-commercial use. You may not scrape, resell, or redistribute the Service or use it to build a competing product without our written permission.
8. No warranty
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied. We do not warrant that any figure, result, odds, or aggregated pick is accurate, complete, current, or error-free, or that the Service will be uninterrupted. Racing data may be delayed, incomplete, or wrong.
9. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, consequential, or gambling-related losses arising from your use of the Service, including any wagers placed or not placed based on information here. In no event will our aggregate liability for any claim relating to the Service exceed the amount you paid us in the twelve months before the claim arose — which, as a free service, is zero.
10. Changes
We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date above. Continued use after a change means you accept the revised Terms.
